Texas has no personal income tax, which is why most callers are surprised by what it does have: a margin tax with a filing obligation even at zero, origin-based sourcing that behaves unlike every neighbouring state, and a software rule that catches every SaaS business in the state.

$0 due still means a return is due

The franchise (margin) tax no-tax-due threshold is $2.65M for 2026. Entities at or below it owe nothing — and must still file a Public or Ownership Information Report.

In the file: The report is built from the books and the ownership record. Businesses that assume “no tax, no filing” find out through a forfeiture notice.

Sourcing is origin-based, and that is unusual

For in-state sellers Texas sources sales to the seller’s location, not the customer’s — the opposite of Florida and most destination-based states.

In the file: A file configured on destination logic mis-states the local portion of the 8.25% combined maximum on every in-state invoice.

80% of a SaaS sale is taxable

Texas treats SaaS and data processing as taxable services with a 20% exemption — so 80% of the sale is subject to tax.

In the file: That is a per-item rule, not a per-invoice one. The item list has to carry the split, or the return is wrong by construction.

Nexus is sales-only, at a high bar

Economic nexus is $500,000 of gross Texas revenue over the trailing twelve months — among the highest in the nation, with no transaction-count test.
